The City Commission approved the Administrative Citation Program for the 2007 Business Plan, and on Tuesday, February 20, the Commission approved the second reading. Although it is very similar to the Uniform Code Citation that is being used presently in code, it is more effective in the area of fines. At the moment, code officers give a written warning with a compliance date prior to the issuance of a citation unless it is a health, safety or welfare issue. The violator then has the option to pay the fine or appear in court on the date specified on the citation. This new program provides special magistrates the authority to impose immediate fines or liens for violations of certain provisions of the City code. The special magistrates will be selected by the City Attorney and approved by the City Commission. Depending on the severity of the violation, code officers will now have the authority to determine if the hearing should be conducted at a county court, or at administrative hearings to be heard by the special magistrates.
